General Terms and Conditions of Use and Sale on the CurvaTrip Website and Application
Article 1 : Purpose
These General Terms and Conditions of Sale and Use (GTCSU) define the rights and obligations of users and purchasers in connection with the sale of airline tickets through CurvaTrip platforms.
Any use of the website, any reservation or any purchase constitutes unconditional acceptance of:
- These GTCSU
- The Privacy Policy
- The fare conditions of the relevant airlines
The Company reserves the right to amend these GTCSU at any time. The version applicable shall be the version in force at the time of purchase.
The user declares that they:
- Are at least 18 years of age
- Have legal capacity
- Are responsible for any use made by minors under their responsibility
Article 2 : Intellectual Property and External Links
2.1 Ownership of the Website and its Content
The website www.curvatrip.com, the CurvaTrip mobile application, and all content made available through them (including, without limitation, text, images, logos, trademarks, graphics, icons, visual elements, databases, software, architecture and source code) are the exclusive property of Sarl Hostelris Marketing Management or are used by it under duly granted rights of use.
Access to the websites and the application is authorized solely for the personal and private use of customers.
Any reproduction, representation, modification, extraction, adaptation, distribution, publication, transmission, resale or exploitation, whether in whole or in part, of the data or content of the website, by any means whatsoever, without the prior, express and written authorization of Sarl Hostelris Marketing Management, is strictly prohibited.
Any unauthorized use constitutes an infringement of intellectual property rights and may give rise to legal proceedings in accordance with the applicable laws of Tunisia.
2.2 Ownership of the Website and Its Content
Sarl Hostelris Marketing Management reserves the right to include on its websites or application hyperlinks to third-party websites, in particular to facilitate users' access to promotional offers or services provided by airlines operating in Tunisia or internationally.
As these third-party websites are independent of CurvaTrip, the Company:
- Exercises no control over their content;
- Does not guarantee their continuous accessibility or availability;
- Does not guarantee the accuracy, reliability or completeness of the information published on them;
- Shall not be liable for any direct or indirect damage resulting from access to or use of such third-party websites.
Users access such websites at their sole risk.
Article 3 : Protection and Confidentiality of Personal Data
Sarl Hostelris Marketing Management undertakes to protect the confidentiality of personal data provided by users when using the website www.curvatrip.com and the CurvaTrip mobile application.
The data collected are used exclusively for:
- Processing reservations and purchases;
- Managing customer relationships;
- Improving the services provided;
- Communications relating to CurvaTrip offers and services;
- Compliance with applicable legal and regulatory obligations.
The Company shall not sell, rent or transfer personal data to third parties, except:
- Where it is legally required to do so;
- Where required by a competent judicial or administrative authority;
- Where disclosure is necessary for the performance of the service (including to airlines, payment service providers and delivery partners), strictly in accordance with the purpose of the processing.
In accordance with applicable Tunisian regulations, Sarl Hostelris Marketing Management undertakes to host and retain personal data on servers located in Tunisia, under conditions that ensure their security and confidentiality.
By using the CurvaTrip websites and application, the user agrees that their personal data may be used for CurvaTrip's own marketing purposes.
The user nevertheless retains the right to object at any time to the use of their data for direct marketing purposes by submitting a written request using the contact details set out in these GTCSU.
Article 4 : Security of Transactions and Data
Sarl Hostelris Marketing Management implements appropriate technical and organizational measures to ensure the security, integrity and confidentiality of personal data and transactions carried out through the website www.curvatrip.com and the CurvaTrip mobile application.
Data exchanges are secured using SSL/TLS (Secure Sockets Layer / Transport Layer Security) encryption. This protocol encrypts information transmitted between the user's browser and the website's servers, including personal data and banking details, using cryptographic algorithms that comply with applicable security standards.
While being transmitted over the Internet, information is encrypted and can be read only by authorized systems possessing the appropriate decryption keys.
A page whose address begins with “https://” indicates that the connection is secure and protected by a valid SSL/TLS certificate.
Online payments are processed through approved secure payment platforms, including SATIM, in accordance with banking standards applicable in Tunisia. Banking data are not stored by CurvaTrip and are processed directly by the relevant payment institutions.
Despite all measures implemented, the user acknowledges that no system for transmitting or storing data over the Internet can be guaranteed to be completely secure. Accordingly, the Company shall not be held liable for any external event beyond its control that compromises data security.
Article 5 : User Obligations
The user undertakes to use the website www.curvatrip.com and the CurvaTrip mobile application fairly, in compliance with applicable Tunisian law and these General Terms and Conditions of Sale and Use.
In particular, users are expressly prohibited from:
- Publishing, distributing or transmitting any defamatory, insulting, discriminatory, political, hateful, obscene, fraudulent or unlawful content;
- Infringing the rights of third parties, including intellectual property rights;
- Using the website for speculative, fraudulent or abusive purposes.
The user also undertakes to:
- Refrain from making fictitious, multiple or abusive reservations intended to block seats without a genuine intention to purchase;
- Provide accurate, complete and up-to-date information when making any reservation or purchase;
- Verify the accuracy of the information provided before confirming the order.
The user remains solely responsible for the consequences arising from any incorrect, incomplete or outdated information provided at the time of reservation, including names, surnames, dates of birth, passport numbers or contact details.
Any breach of these obligations may result in:
- Immediate cancellation of current reservations;
- Suspension or deletion of the user account;
- Temporary or permanent exclusion from the platform;
- Where applicable, legal proceedings in accordance with applicable law.
Article 6 : Procedure for Purchasing an Airline Ticket
The purchase of an airline ticket through the website www.curvatrip.com or the CurvaTrip mobile application is carried out as follows:
6.1 Account Creation
The customer may:
- Create a personal account by providing a username and password;
- Or make a purchase without creating an account.
Creating an account is not mandatory, but is recommended so that customers can view their reservation history, manage their tickets and facilitate future transactions.
The customer is responsible for maintaining the confidentiality of their login credentials.
6.2 Information Entry
The customer must accurately provide all information required for:
- Issuance of the travel document (surname, first name, date of birth, etc.);
- Billing;
- Processing of the order.
Any error in the information provided may result in additional charges or make it impossible to issue or modify the ticket, in accordance with the airline's fare conditions.
6.3 Purchase Confirmation
Once payment has been validated, a confirmation email is sent to the email address provided by the customer and includes:
- The reservation reference;
- Flight details;
- The electronic ticket as an attachment, where applicable.
The customer is responsible for checking the accuracy of the information shown on the ticket immediately upon receipt.
6.4 Service Availability
The customer may make a reservation or purchase 24 hours a day, 7 days a week, subject to:
- Scheduled technical maintenance;
- Interruptions beyond CurvaTrip's control;
- Temporary unavailability of airline systems or payment platforms.
6.5 Customer Commitment in Case of Cash-on-Delivery Payment
Where payment on delivery is selected, the customer undertakes to:
- Remain reachable at the telephone number provided at the time of reservation;
- Be present at the agreed place and time for receipt and payment.
If delivery cannot be completed due to the customer's absence or unavailability, CurvaTrip reserves the right to:
- Reschedule a further delivery attempt;
- Or cancel the reservation if the confirmation conditions are not met.
Article 7 : Ticket Availability (Display of Flights, Schedules, and Fares)
The website www.curvatrip.com and the CurvaTrip mobile application display flight schedules offered by various airlines operating in Tunisia and internationally, together with the corresponding fares supplied by those airlines or their distribution systems.
The schedules, itineraries and fares displayed are provided for information purposes only and may be changed at any time by the airlines, including for operational, technical, commercial or regulatory reasons.
The display of a flight or fare during a search does not constitute a final guarantee of availability. The actual availability of a ticket and its price are confirmed only upon:
- Confirmation of the reservation;
- And, where applicable, full payment of the order within the prescribed period.
Because airline reservation systems are dynamic, a flight or fare displayed at the time of the search may no longer be available at the time of confirmation. In such a case, the customer will be informed and may, where appropriate, accept an alternative or withdraw from the reservation.
Sarl Hostelris Marketing Management shall not be held liable for changes to schedules, fares, itineraries or availability decided by the airlines.
Articles 8 : Limitations and Reasonable Use
8.1 Number of Passengers per Booking
The customer may make a reservation for up to nine (09) passengers per booking, including adults, children and infants.
Each infant must be accompanied by at least one adult, in accordance with airline rules.
8.2 Reservation Limitations
The customer may purchase an unlimited number of tickets, subject to compliance with these terms and conditions.
However, in order to prevent abuse and speculative reservations, the platform may limit the number of active reservations per customer to two (02) reservations per week, unless prior authorization has been granted by CurvaTrip.
The Company reserves the right to adjust these limits in accordance with airline policies, technical constraints or fraud-prevention measures.
8.3 Abusive or Speculative Reservations
The user undertakes not to make excessive, fictitious or repetitive reservations intended to:
- Block seats without a genuine intention to purchase;
- Circumvent fare rules;
- Or disrupt the proper operation of the platform.
Where abuse is identified, Sarl Hostelris Marketing Management reserves the right, without prior notice, to:
- Cancel the relevant reservations;
- Suspend or delete the user account;
- Permanently prohibit access to the platform;
- And, where appropriate, take any suitable action in accordance with applicable law.
This version is legally more robust because:
- It protects against large-scale abusive reservations
- It gives you discretionary authority in cases of fraud
- It remains consistent with airline practices
Article 9 : Retention of Title and Ticket Issuance
Airline tickets sold through the website www.curvatrip.com and the CurvaTrip mobile application shall not be considered definitively issued until the ticket price and, where applicable, any service or delivery fees have been paid in full.
Until the order has been fully and effectively paid, Sarl Hostelris Marketing Management reserves the right to:
- Suspend or cancel the reservation;
- Refrain from issuing the electronic ticket;
- Refuse final confirmation of the travel document.
The airline ticket constitutes an electronic travel document subject to the general conditions of carriage of the relevant airline. It becomes valid only after confirmation by the airline's reservation system and receipt of full payment.
In the event of non-payment, bank rejection, payment dispute or cancellation of the transaction, the reservation may be automatically cancelled without prior notice.
Article 10 : Fare Conditions
The fare conditions applicable to each ticket are displayed during the itinerary search and are available before the purchase is confirmed on the website www.curvatrip.com and the CurvaTrip mobile application.
These conditions include, without limitation:
- Refund rules;
- Conditions for modifications or date changes;
- Any applicable penalties;
- Applicable restrictions (non-changeable ticket, non-refundable ticket, etc.);
- The validity period of the reservation.
Airline tickets are subject to the general conditions of carriage of the relevant airline. Each airline applies specific fare rules depending on the booking class, fare type (promotional, flexible, business, etc.) and applicable commercial conditions.
The customer acknowledges that they are solely responsible for reading, understanding and accepting the fare conditions before confirming any order.
Sarl Hostelris Marketing Management shall not be held liable where a modification, cancellation or refund is not possible due to fare restrictions imposed by the airline.
Article 11 : Prices and Payment Terms
11.1 Applicable Prices
The fares for tickets sold through the website www.curvatrip.com and the CurvaTrip mobile application are those in effect at the time of reservation or purchase.
Prices are:
- Expressed in Tunisian Dinars (TND);
- Calculated inclusive of all taxes;
- Exclusive of any applicable delivery or service fees, which are specified before final confirmation of the order.
Fares may include service fees charged by CurvaTrip as well as taxes and surcharges imposed by airlines or the competent authorities.
11.2 Price Fluctuations and Availability
Due to the dynamic nature of airline reservation systems, ticket prices may change rapidly depending on:
- Seat availability;
- Airline pricing policies;
- Applicable commercial conditions.
The price displayed during a search can only be guaranteed at the time of confirmation and effective payment.
A reservation may temporarily hold a fare for the stated validity period. However, if the payment deadline is not met, the reservation is automatically cancelled and the fare may no longer be available.
11.3 Acceptance of Conditions Before Payment
Before confirming any payment, the customer must:
- Read and accept these General Terms and Conditions of Sale and Use;
- Review the fare conditions applicable to the selected ticket.
Validation of payment constitutes final acceptance of the order and the associated conditions.
11.4 Payment Security
Transactions are secured using payment technologies that comply with applicable standards.
After the travel information has been validated, the customer is redirected to the secure SATIM payment platform, which is responsible for:
- Verifying the validity of the bank card;
- Authorizing the transaction;
- Automatically transferring the amount corresponding to the purchase.
Banking data are not stored by CurvaTrip and are processed exclusively by the approved payment platform.
11.5 Available Payment Methods
The customer may pay for airline ticket purchases using one of the following payment methods:
- EDAHABIA Card (Tunisie Poste)
- CIB Interbank Card
- Payment on delivery, subject to the conditions set out in the articles relating to delivery.
Each payment method is subject to specific conditions, which are detailed in the following sections.
Article 12 : Ticket Delivery and Confirmation
12.1 Delivery Methods
Where the customer selects payment on delivery, the ticket is delivered in person to the address provided at the time of reservation or to the collection point agreed with the customer.
Delivery charges are payable by the customer. The amount of such charges is communicated before final confirmation of the reservation.
12.2 Confirmation Deadline and Conditions
Given the specific nature of air transport and the rapid fluctuation of availability, confirmation of the ticket is subject to:
- Compliance with the validity period of the reservation;
- Full payment of the amount due at the time of delivery.
The delivery period remains strictly limited by the fare conditions applicable to the selected ticket. Customers are advised to review these conditions before making a reservation in order to avoid cancellation due to expiry of the applicable deadline.
12.3 Delivery Arrangements
Deliveries are carried out by CurvaTrip's internal services or by authorized partners.
The customer is contacted by telephone to confirm:
- The delivery address;
- The agreed date and time.
The customer undertakes to remain reachable and to be present at the time of delivery.
12.4 Customer Absence or Unavailability
In the event of:
- The customer's absence;
- Unavailability at the agreed time;
- Or non-payment on delivery;
The reservation may be cancelled without any right of recourse against CurvaTrip.
The Company shall not be held liable for any loss of availability or fare change resulting from cancellation due to non-compliance with the delivery conditions.
12.5 Ticket Confirmation
No ticket may be confirmed or issued until full payment has been made.
Once confirmed, the electronic ticket is sent to the email address provided at the time of reservation.
The customer must immediately verify:
- The accuracy of the information;
- Actual receipt of the ticket.
12.6 Errors Attributable to the Customer
If the customer makes an error when entering information (surname, first name, date of birth, etc.), CurvaTrip shall not be held liable.
Any request for modification or refund shall be subject exclusively to the fare conditions of the relevant airline and may result in additional charges.
Article 13 : Complaints, Communications, and Personal Data
13.1 Customer Service and Complaints
For any request for information, assistance or complaint relating to the services provided, including reservations or online payments, the customer may contact CurvaTrip Customer Service using the following details:

Customer Service is available every day, 24 hours a day, subject to any technical interruptions or events of force majeure.
Any complaint must be submitted within a reasonable period after the event giving rise to it and must be accompanied by the necessary supporting documents (reservation reference, proof of payment, etc.).
13.2 Collection and Use of Personal Data
As part of its business activities, Sarl Hostelris Marketing Management, the operator of the CurvaTrip platform, may collect identifying information and personal data relating to its customers.
Such data are collected and processed in particular for:
- Managing reservations and orders;
- Processing payments;
- Issuing tickets;
- Continuously improving services;
- Communication and marketing activities, in compliance with applicable regulations.
Data strictly necessary for the performance of the service may be shared with CurvaTrip partners, including:
- Airlines;
- Approved payment platforms;
- Delivery companies.
These partners are required to maintain the confidentiality of the data transmitted to them.
13.3 Data Hosting and Retention
In accordance with applicable Tunisian regulations, personal data are stored on servers located in Tunisia and protected by appropriate security measures.
Data are retained for the period necessary to manage contractual relationships, comply with legal and regulatory obligations, and for security purposes
Article 14 : Right of Withdrawal and Refund Conditions
14.1 Absence of Right of Withdrawal
Given the specific nature of air transport services, the customer does not have a right of withdrawal once the airline ticket has been confirmed and issued.
Any reservation that has been confirmed and paid is deemed firm and final, subject to the fare conditions applicable to the relevant ticket.
14.2 Refund Conditions
The availability of a refund, modification or cancellation of a ticket is governed exclusively by:
- The fare conditions of the relevant airline;
- The rules applicable to the selected booking class;
- The commercial policies in force at the time of purchase.
Certain tickets may be:
- Non-refundable;
- Non-changeable;
- Or subject to penalties.
The customer must review and accept these conditions before confirming the purchase.
14.3 Refund Procedure
Any refund request must be submitted through:
- The “Manage My Booking” menu on the website or application;
- Or by contacting Customer Service.
Where a refund is authorized by the airline:
- It is made using the original payment method used for the purchase;
- Subject to the continued validity of the payment method;
- And after deduction of any applicable penalty and service fees.
Refund processing times depend on the processing times of the airline and the relevant banking institutions.
14.4 Special Cases
Where a cancellation or modification is imposed by the airline (flight cancellation, schedule change, etc.), the applicable refund or rerouting conditions are determined by the airline in accordance with its commercial policy and applicable regulations.
Sarl Hostelris Marketing Management acts solely as an intermediary and shall not be held liable for decisions made by the airline.
Article 15 : Transportation Document (“Ticket”)
15.1 Ticket Issuance
Following payment validation and final confirmation of the reservation, the electronic travel document (“ticket”) may be displayed on screen and printed by the customer.
The electronic ticket, together with the applicable fare conditions, is also sent to the email address provided at the time of reservation.
The customer must immediately verify:
- The accuracy of the information shown on the ticket (surname, first name, dates, itinerary, etc.);
- Successful receipt of the confirmation email.
In the event of an error or non-receipt, the customer must contact Customer Service as soon as possible.
15.2 Access to the Ticket
The customer may, at any time, view and download a copy of their ticket through the website www.curvatrip.com or the CurvaTrip mobile application under the “Manage My Booking” section.
Access to the ticket is subject to the provision of the necessary identification information (reservation reference, passenger name or access to the customer account).
15.3 Modification or Cancellation
Any request to modify or cancel the ticket must be submitted through:
- The “Manage My Booking” menu;
- Or by contacting Customer Service.
Modifications and cancellations are subject exclusively to the fare conditions of the purchased ticket and the rules of the relevant airline.
Modification fees, penalties or non-refundability may apply depending on the selected fare type.
Sarl Hostelris Marketing Management acts as an intermediary and cannot guarantee that a modification or cancellation will be possible where the fare conditions do not permit it.
Article 16 : Fees, Taxes, and Surcharges
Unless otherwise stated, the ticket price displayed on the website www.curvatrip.com and the CurvaTrip mobile application includes:
- The base air fare;
- Airport taxes;
- Safety and security charges;
- Fuel surcharges or other surcharges imposed by the airline;
- Applicable service fees.
These amounts are included in the total price displayed at the time the order is confirmed.
However, certain airport authorities or countries may require the payment of local taxes, specific charges or additional fees directly at the airport at the time of departure, transit or arrival. Such amounts are not included in the ticket price where they are collected locally by the competent authorities.
Sarl Hostelris Marketing Management shall not be held liable for the payment of such local taxes imposed independently of the reservation made through the CurvaTrip platform.
Article 17 : Travel Documents
The passenger is solely responsible for obtaining and ensuring the validity of all documents required for travel, including:
- A valid passport;
- A visa, where applicable;
- Transit authorizations;
- Health documents or certificates required by the competent authorities;
- Exit authorizations for minors, where applicable.
Before making a reservation and before departure, the passenger must verify the specific requirements of the countries of departure, destination and transit, as well as the rules imposed by the airline.
Any costs associated with obtaining or renewing these documents are borne exclusively by the passenger and are not included in the ticket price.
If boarding, entry into a territory or transit is refused because the required documents are missing or irregular, Sarl Hostelris Marketing Management shall not be held liable. No refund may be claimed except in accordance with the fare conditions applicable to the ticket.
Article 18 : Force Majeure
The website www.curvatrip.com and the CurvaTrip mobile application, operated by Sarl Hostelris Marketing Management, shall not be liable for any failure, partial performance or delay in the performance of any obligation resulting from an event of force majeure.
An event of force majeure means any external, unforeseeable and unavoidable event beyond the Company's control, including, without limitation:
- Natural disasters (earthquake, flood, fire, storm, etc.);
- Armed conflicts, civil unrest or acts of terrorism;
- Pandemics or public health emergencies;
- Strikes, social unrest or administrative decisions;
- Closure of airspace;
- Failure of reservation systems or telecommunications networks;
- Decisions or restrictions imposed by public authorities.
If a force majeure event occurs, performance of the affected obligations shall be suspended for the duration of the event.
The Company shall not be held liable for any direct or indirect consequences arising from such an event, including any flight cancellation, modification or delay decided by the airline or the competent authorities.
Article 19 : Severability
If any provision of these General Terms and Conditions of Sale and Use is declared null, unlawful or unenforceable by a court or competent authority, that provision shall be deemed unwritten to the extent of its invalidity, without affecting the validity or enforceability of the remaining provisions, which shall remain in full force and effect.
Where a provision would become valid and enforceable if part of it were deleted or amended, that provision shall be interpreted so as to reflect as closely as possible the parties' original intention while complying with applicable regulations.
The potential invalidity of any clause shall in no way affect the validity of the other clauses of these General Terms and Conditions.
Article 20 : Applicable Law and Competent Jurisdiction
These General Terms and Conditions of Sale and Use are governed by and construed in accordance with Tunisian law.
In the event of a dispute relating to the validity, interpretation, performance or termination of these terms and conditions, the parties undertake to seek an amicable solution before initiating legal proceedings.
If no amicable agreement is reached, the dispute shall be brought before the competent courts of Tunisia, in accordance with the jurisdictional rules provided for by applicable law.
However, any mandatory legal provisions that may apply under national or international rules governing jurisdiction shall remain applicable.
